For the purposes of these general terms and conditions of sale, it is agreed that the customers and Le Domaine du Fortin will be collectively referred to as the "Parties" and individually referred to as the "Party", and that the user who has validated a reservation or an order will then be referred to as the "customer".
These terms and conditions apply to all countries and currencies. Any reservation or order implies full acceptance of the general terms and conditions of sale.Domaine du Fortin reserves the right to modify these terms and conditions of sale at any time by publishing a new version on the Site. The general terms and conditions of sale applicable remain those in force at the date of the reservation or order.
ARTICLE 1: GLOSSARY"Confirmation e-mail": e-mail sent by Le Domaine du Fortin as the final step in the reservation or order process. This summarizes the reservation validated by the customer and confirms its receipt by the site www.ledomainedufortin.com. The confirmation email constitutes a reservation confirmation as defined below."Booking confirmation": A dematerialized document that summarizes the characteristics of the services booked at the end of the booking process and its validation by the customer. The reservation confirmation is issued in particular after a reservation has been made on the www.ledomainedufortin.com website, during which the customer's credit card number is entered as part of an online payment or guarantee, prior to final validation."Establishment Contract": Contract whose purpose is the provision by the Hotel Madison establishments of all the services defined below and which have actually been ordered by the Customer following the validation of his/her reservation online or by another reservation method."Customer": An individual of legal age who has full legal capacity at the time of signing the establishment's contract."Reservation request": Reservation request for rooms or the entire property, made by the customer via mobile communication services or the Internet."Mobile services": All services and protocols enabling cell phones to be connected to the Internet, and in particular enabling consultation and reservation of the services provided by Le Domaine du Fortin."Online booking": Booking of rooms, the entire property and any accessories or additional services offered by Le Domaine du Fortin on its website www.ledomainedufortin.com." Reservation by telephone or e-mail": Reservation of rooms or additional services offered by Le Domaine du Fortin by telephone call or by sending an e-mail by the Customer, complying with the reservation registration process as described in these general terms and conditions of sale. "Establishment": Refers to Le Domaine du Fortin with rooms or any additional services offered on the www.ledomainedufortin.com website. "Services": Services marketed by Le Domaine du Fortin consisting, within the framework of a contract with the establishment, of the provision of rooms or the entire property, the essential characteristics of which are presented on the www.ledomainedufortin.com website, with or without the provision of meals and/or breakfasts and other complementary services linked to temporary accommodation, in particular artistic entertainment. In accordance with the provisions of article L. 111-1 of the French Consumer Code, these services are listed on the www.ledomainedufortin.com website. "Extras": services marketed by Le Domaine du Fortin consisting, within the framework of a contract between the establishment and customers, of services that are different from and complementary to those offered in the provision of rooms, the essential characteristics of which are presented on the www.ledomainedufortin.com website. "Website": electronic service operated by Le Domaine du Fortin on the Internet and accessible via the following URL: www.ledomainedufortin.com."WAP": communication protocol whose purpose is to enable access to the Internet using a mobile terminal.
ARTICLE 2: SCOPE OF APPLICATION
2.1 SCOPE These general terms and conditions apply, without restriction or reservation, to all the services offered on the www.ledomainedufortin.com website by Le Domaine du Fortin, which operates the aforementioned site, in particular for the purposes of booking rooms and other services complementary to temporary accommodation in the establishment.
2.1.2. These General Terms and Conditions apply to all subscription operations for the services defined above carried out by the Customer.
2.2 TERRITORY The services listed on this website are offered to be provided to the Customer by Le Domaine du Fortin in one of its establishments to the exclusion of any other location following an effective reservation by the Customer.
2.3 DURATION
2.3.1. These general terms and conditions apply for as long as the services are online at www.ledomainedufortin.com.
2.3.2. Le Domaine du Fortin reserves the right, without prior notice or compensation, to temporarily or permanently close the website www.ledomainedufortin.com or the online reservation area.
2.3.3. Domaine du Fortin is not liable for damages of any kind that may result from the temporary unavailability or permanent closure of all or part of the site or the services associated with it, such as the online reservation area.
2.4 LEGAL STATUS
2.4.1. These general terms and conditions are subject to the provisions of articles L. 121-16 et seq. of the French Consumer Code.2.4.2. All reservations for the consumption of the services defined above, made on the www.ledomainedufortin.com website, are subject to the present general and special conditions of tariffs for each of the said Le Domaine du Fortin services listed below.
2.5. PURPOSE
2.5.1. These general terms and conditions define the rights and obligations of the parties in the context of the remote booking of services offered by Le Domaine du Fortin on its website www.ledomainedufortin.com.
2.5.2 They govern all the steps necessary for the reservation and follow-up of the reservation between the contracting parties, its maintenance and its validity.
ARTICLE 3: CAPACITY AND ACCEPTANCE OF THE CUSTOMER
3.1 All customers acknowledge that they have the capacity to contract under the conditions described in the general terms and conditions presented below, i.e. that they are of legal age and not under guardianship or trusteeship. However, the Management of the establishment reserves the right to request proof of identity from the Customer on arrival at the establishment, including, in particular, an indication of the Customer's date of birth.
3.2. The Customer acknowledges that these conditions are an integral part of the establishment's contract.
3.3. The Customer accepts that the General Terms and Conditions, the contractual documents informing him/her of the specific services and rates for each of the services, as well as the order forms and the procedures for doing so, are presented to him/her online at www.ledomainedufortin.com for the purposes of concluding the Facility Agreement.
3.4. The Customer declares that he has obtained all necessary information from Le Domaine du Fortin on the www.ledomainedufortin.com website.
3.5. The Customer acknowledges that he/she has read and accepted these terms and conditions and all the terms of the proposal before placing the order and that he/she accepts all the terms.
3.6. Any online booking validation by the Customer on the www.ledomainedufortin.com website implies prior consultation and acceptance of the present terms and conditions.
3.7. The Customer's agreement to the present terms and conditions is obtained during the booking process, prior to validation of the reservation.
3.8. The Customer, prior to ordering the services, declares that the reservation of these services is made for his/her personal needs.
3.9. The Customer has the option of saving and editing these general terms and conditions from the www.ledomainedufortin.com website, using the standard functions of his/her browser and/or computer, in particular under the "General Terms and Conditions" tab.
3.10. The Customer expressly accepts that the entry of the required banking information, the acceptance of the present general terms and conditions and the validation of the voucher or reservation request constitute an electronic signature within the meaning of article 1316-4 of the French Civil Code, which has the same value between the parties as a handwritten signature.
3.11. The Customer, upon presentation of his identity document as stated in article 3.1 above, undertakes to complete the individual police form in the countries concerned by this article, in accordance with the provisions of article R. 611-42 of the Code de l'Entrée et du Séjour des Etrangers.
ARTICLE 4: SITE CONTENT4.1. The site contains the following information:The identification of the company SAS Andrieux et compagnie, indicating its corporate name, the address where it is established, and its e-mail address.
The essential characteristics of the accommodation offered (the information sheets for each category of rooms offered can be consulted before booking under the heading "SUITES", during the booking process under the room availability calendar and during the choice of room according to the dates chosen by the Customer for his booking, which may be illustrated by a photographic image of a room at the same rate. It should be noted, however, that PHOTOS ARE NOT CONTRACTUAL insofar as interior presentation or decoration elements and room sizes vary within the same establishment or from one establishment to another).
Throughout the site there are photos illustrating the entire property and providing information on the services and facilities on offer.
Prices for each of the accommodation and complementary services.

ARTICLE 5: RESERVATION
5.1. ONLINE RESERVATION PROCEDURES
5.1.1. The Customer chooses the services presented on the www.ledomainedufortin.com website, which offers the possibility of reserving a room or the entire property, according to transparent contractual rates with or without options or Extras left to the Customer's free choice.
5.1.2. The Customer acknowledges that he/she is aware of the nature, purpose and reservation terms of the services available on the wwww.ledomainedufortin.com website, and that he/she has requested and obtained the necessary and/or additional information to make a reservation with full knowledge of the facts.
5.1.3. The Customer is solely responsible for the choice of services and their suitability for his/her needs, and Le Domaine du Fortin cannot be held liable in this respect.
5.1.4. The reservation is deemed accepted by the customer at the end of the reservation process by clicking on the "CONFIRM RESERVATION" field.
5.2. ONLINE BOOKING PROCESS5.2.1. The reservation is confirmed upon receipt by the customer of the reservation confirmation sent by Le Domaine du Fortin, or upon online payment by credit card under the conditions set out in article
5.2.4. A confirmation screen will then appear online.
5.2.2. Prior to any reservation, the Customer undertakes to complete the information requested.
5.2.3. The customer attests to the truthfulness and accuracy of the information provided.
5.2.4. The reservation procedure, secured under the conditions of article 9 below, includes the following stages, it being specified that it is always possible for the customer to reverse the reservation process:
Choice of location: the customer selects the establishment by clicking on the city of stay.
Choice of start date (arrival) and end date (departure)
If the arrival and departure dates have not been entered, a calendar is displayed showing available or fully booked days for the previously selected establishment. For each available day, the calendar shows the best available rate under the date. This shows the best available rate per night and per customer. By clicking on the dates, customers can select their day of arrival and departure and access the following steps.
Choice of number of rooms booked : The customer clicks on the number of rooms selected for the dates of his stay. If several rooms are booked, the booking process continues room by room.
Selecting the number of adults per room: The customer clicks to select the number of adults per room.
Choice of number of children for the room: The customer determines the number of children per room by clicking. The property is not suitable for children under 12.
Choice of rooms and associated rates: The customer chooses by clicking between the different rooms and rates available based on the information entered in the previous steps, including their essential characteristics, such as the category of the room at the date previously chosen, its price, its level of equipment, any Extras included for special offers, cancellation conditions, payment conditions. Please note that any photos or perspectives included on the site are non-contractual.
Choice of Extras: the customer can add, by a simple click and according to their availability, one or more extras proposed according to the information entered during the previous steps. These extras display prices, quantities and special features. By clicking on "add" or "add an element", the customer completes the selection and entry of the elements that are the subject of the online reservation, without prejudice to the possibility of modifying the elements of the reservation by going back to the previous reservation process.
Booking summary: the booking summary is displayed on the left-hand side of the screen.
Finalize reservation : By clicking on the "Confirm my booking" button, the customer validates the elements summarized and displayed as part of the booking, and displays the fields required for the customer to enter his or her identity, contact details (including postal address, e-mail address and telephone number) and type of stay, as well as the method of payment and credit card details used for online payment, and to provide a guarantee by credit card details depending on the rate chosen; acceptance of the present general terms and conditions; final validation of the reservation by the customer by clicking on the "Confirm reservation" field at the bottom of the page. By clicking on "Confirm booking", the customer pays, or gives a guarantee by credit card, according to the rate they have booked. Last step: Le Domaine du Fortin registers the reservation made by the customer and assigns a confirmation number or reservation email.
5.3. FORMATION OF THE ONLINE CONTRACT
5.3.1. In accordance with articles 3.10 and 5.2.4, the Premises Contract is formed at the time of the Customer's reservation confirmation by Le Domaine du Fortin including the allocation of the relevant reference number as stated in the previous article.
5.3.2. The establishment's contract can only be formed once the Customer has chosen the content of his/her reservation, which has been completely recapitulated in the last stage of the reservation process, has accepted the present general conditions and finally has validated his/her reservation by clicking on the "Confirm reservation" button. Failing this, the reservation is considered interrupted and cannot produce any effect.
5.3.3. In all cases of online reservation, a summary e-mail is sent to the Customer at the e-mail address indicated in the field reserved for this purpose. This e-mail constitutes an acknowledgement of receipt of the booking and confirmation of the booking, summarizing the terms of the contract, the services booked, the prices, the price conditions relating to the tariff selected, information relating to after-sales service and commercial guarantees if any, the procedures for exercising any right of withdrawal or cancellation, and the address of Le Domaine du Fortin to which the customer may submit any complaints.
5.4. OTHER RESERVATION METHODS (OTHER THAN ONLINE)
5.4.1. Booking by telephone
5.4.1.1. Reservations by telephone, as defined below, are made using the telephone numbers listed.
5.4.1.2. When the customer requests a reservation by telephone, the Domaine du Fortin offers the available rates and related additional services according to the customer's request for the dates requested. The Domaine du Fortin also requests a telephone number and e-mail address where the Domaine du Fortin will send the Customer these general terms and conditions of sale, together with a summary of the Customer's booking request, and, where applicable, a request for bank details for the purposes of recording the Customer's booking, with or without payment during the booking process of the price, a deposit or a guarantee by bank card details depending on the applicable rate determined by the Customer at the time of the booking request.
5.4.1.3. All the information and conditions required by Le Domaine du Fortin in response to the Customer's telephone reservation request constitute essential formalities for the registration of the Customer's telephone reservation. Failing this, the reservation cannot be validated or confirmed.
5.4.1.4. By returning the information required by Le Domaine du Fortin by e-mail at the very least, the Customer will not be able to complain about the failure to register his reservation, and the establishment's contract will not be formed as a result of the Customer's failure to provide this information and these conditions. Only written confirmation of the reservation will be deemed to constitute the conclusion of the contract.
5.4.3. Booking by e-mail
5.4.3.1. Reservations by e-mail, as defined below, must be made to the e-mail address indicated on the site pages, i.e. [email protected].
5.4.3.2. When a reservation request is made by e-mail, Le Domaine du Fortin will propose, by return e-mail to the address from which the reservation request is made, the available rates and related additional services, according to the Customer's request for the dates requested. By the same return e-mail, the Domaine du Fortin will send the Customer these general terms and conditions of sale at his request, together with a summary of his reservation request, and, where applicable, a request for bank details for the purposes of registering his reservation, with or without payment during the reservation process of the price, a deposit or the security deposit of a guarantee by bank card details depending on the applicable rate determined by the Customer at the time of his reservation request.
5.4.3.3. All the information and conditions required by Le Domaine du Fortin in response to the Customer's reservation request by e-mail constitute substantial formalities for the registration of the Customer's reservation made by e-mail. Should the Customer, having made a reservation request by e-mail, fail to comply with the requirements of the present general terms and conditions of sale of Le Domaine du Fortin, the Customer may not complain about the failure to register his reservation. Only the written confirmation of the reservation is valid.
5.5 Right of Withdrawal / Cancellation by the Customer :
5.5.1 In accordance with article L. 121-20-4 of the French Consumer Code, the Customer is reminded that he/she does not have the right of withdrawal as provided for in article L. 121-20 of the French Consumer Code, if the services are provided on a specific date or at a specific time.
5.5.2. Without prejudice to the provisions of article 5.5.1, the contractual conditions may, where applicable, provide for a right of cancellation, depending on the content of the reservation validated by the Customer, and as indicated for each rate, when the reservation is made under the heading "Flexible rate / Tarifs flexibles". In this case, the customer has been informed of the relevant cancellation conditions. These conditions are also explained during the various stages leading up to payment.
5.5.3. The right of cancellation defined in article
5.5.2 may be exercised by the customer on the www.ledomainedufortin.com website, on the my account page, after logging in with his/her confirmation number or email and password. The option tab then proposes cancellation of the reservation. By clicking on the OK button, the cancellation will take effect immediately and all packages associated with this booking will also be cancelled. An email confirming the cancellation will then be sent to the customer.
5.5.3.1 Depending on the offers selected by the customer, cancellation by telephone is also possible. This must be accompanied by an email from the customer, followed by a cancellation confirmation email from Le Domaine du Fortin.
5.5.4. In the event of interruption of the stay, the full agreed price will be collected, with no right to reimbursement, credit note or exchange for the Customer for the unused part of the stay in the establishment. In the case of reservations where payment is made at the time of booking, no refund will be granted.
5.5.5. Unless otherwise expressly stipulated, in particular in the case of the purchase of extras for this purpose, the customer must leave the room before 12.00 p.m. on the day of the end of his stay (guest house period) or before 09:00 a.m. on the day of the end of his stay (seasonal rental period). Failing this, and subject to availability, a late check-out will be offered. This will be billed at 50% of the room price on the day of the late check-out. This rate will end at 6pm French time. After this time, the guest will be charged for an additional night (during the bed and breakfast period) or an additional week (during the vacation rental period). Rates per night/week will vary according to the room/house occupied and the day/week monopolized. If a room/house is not available, Le Domaine du Fortin reserves the right to access the unoccupied room/house in order to prepare it for new arrivals.
5.5.6. Without prejudice to the application of the right of cancellation under the conditions of article
5. 5 for "Flexible rates", any no-show or no-show (reservation not cancelled in the event of a right of cancellation and customer not present) without prior notice from the establishment to take possession of the room booked by the Customer, shall constitute release of the reservation in its entirety, implying re-availability of the night(s) booked, and shall automatically entail payment of the first night's charges relating to the stay booked, including all extras booked, all taxes included, without any right of reimbursement to the Customer.
5.5.7. The conditions set out in article 6 apply to all reservation methods: internet, email, telephone or social networks

ARTICLE 6: RATES & PRICES
6.1. Prices relating to the reservation of services are indicated during the room reservation process. Prices are valid in real time and are displayed in accordance with article 5.2.4. Similarly, for other reservation methods by telephone or e-mail, rates are valid at the time of the Customer's reservation request. In any event, the specific pricing conditions for each rate/room type or additional service are shown opposite each of the services booked by the Customer. For seasonal rentals, prices will be provided when availability is requested.Breakfast is always included in the room rate and is not deductible in the event of no consumption.
6.2. The prices indicated are per double room occupied for one or two people, it being specified that the chosen rate implies by default and unless a particular "extra" is subscribed for this purpose, a check-in by the Customer at 3 pm and a check-out at 12 pm.
At check-in, (bed and breakfast/seasonal rental) a credit card imprint and proof of identity will be required. In the event of a no-show at check-out, Le Domaine du Fortin reserves the right to charge the credit card used at check-in.6.3. Prices are subject to value-added tax (VAT) and are shown inclusive of VAT at the rate in force at the time of booking confirmation, in Euros or in the currency selected by the customer. Prices shown are valid only for the period indicated on the website.
6.4. If payment is made in a currency other than the currency of the customer's country of residence, exchange charges will be borne by the customer.
6.5. All bookings are payable in Euros as specified during the booking process.
6.6. Unless otherwise stated, additional services and any other extras selected are not included in the price. However, the price of these additional services validated in the Customer’s booking is due during the online or offline booking process as long as the rate is different from the "Flexible Rates/Rate". These rates are also subject to VAT at the rate in force at the time of booking, if applicable, depending on the regulations applicable for these categories of products or services at a rate other than that applicable to the reservation of rooms.
6.7. Tourist tax: the amount of the tourist tax is provided per day and per person, for information purposes, and is subject to change. This tax collected for the benefit of the municipalities of Paris will be paid, on site, during the stay.
6.8. The prices take into account the VAT applicable on the day of the order and any change in the rate applicable to the VAT will be automatically passed on to the prices indicated, in particular in the event of a change in the rate applicable to the day of consumption of the stay and the Extras subscribed against the rates applicable at the time the booking was made.
6.9. If a fare implies that payment is made at the establishment at the time of arrival or departure of your stay, and the currency of the client is not the same as that of the country in which the establishment is located, the rate charged by the latter is likely to be different from that communicated at the time of booking, taking into account the possible evolution of exchange rates between the date of booking and the dates of stay at the establishment.
6.10. Any items stolen from the house during the stay will be charged at the current rate. rates are available upon request.6.11. In case of degradation of the room, the common parts or miscellaneous objects, Le Domaine du Fortin reserves the right to charge the customer for the damages caused.
ARTICLE 7: PAYMENT
7.1. The Customer provides its bank details as a guarantee of the reservation except under special conditions or rates requiring an online payment as stipulated during the booking process and, in particular, those proposed under the wording “internet, best available rate”.The means of payment are secured by SSL encryption. The following information will be requested in order to finalize your reservations: card number, validity date and visual cryptogram as part of an online payment via the dedicated payment platform. The same applies to the communication of the bank details required for reservations made by telephone or e-mail according to the formal conditions required which imply either a payment at the time of booking, the requirement for a security deposit by credit card imprint according to the booking price.
7.2. Payment shall be debited from the establishment at the time of the stay, except in the case of special conditions or rates where the payment is debited at the time of booking when certain rates are subject to the requirement of payment during the booking process according to the specific contractual conditions relating thereto previously accepted by the Customer.
7.3. The service provider chosen by Le Domaine du Fortin to secure online payments by bank card, performs a verification of the validity of the customer’s payment card. The payment card may be refused for several reasons: stolen card, blocked card, cap reached, input error… In case of difficulty or impediment, the customer must contact his bank on the one hand to identify his origin, on the other hand, the establishment to confirm his reservation and his method of payment.
7.4. If the customer reserves several rooms but the payment, online and in any case during the booking process, is only necessary for one room for example, in this case, the payment card that is used on the payment platform allows, on the one hand, to pay the room concerned by the payment online and, in any case during the booking process, on the other hand to serve as guarantee for the other rooms.
7.5. At the time of online payment and in any case when it is required during the booking process, the amount charged at the time of booking includes: the price of the accommodation, the taxes related to the accommodation, the price of additional services or «extras».
7.6. In the case of a tariff subject to on-line payment, the debit is made at the time of completion of its booking by the Customer following an on-line computer debit process.
7.7. Following the stay in Le Domaine du Fortin and regardless of how the booking took place, an invoice shall be drawn up in duplicate by Le Domaine du Fortin, a copy of which shall be delivered or sent by email to the Client upon departure from the establishment.
If the reservation has not been made for the occupant of the room/house, he will only receive an invoice for the services requested from the day of arrival and that they are not prepaid in advance.
7.8. Payment by cheque is not accepted, whether it is a temporary accommodation benefit, and/or catering services and/or any other services or sales of products delivered by Le Domaine du Fortin to the Customer during his stay in the establishment.7.9 In any event, any "Extras" or other service that has been booked and delivered by Le Domaine du Fortin during the Client’s stay and that has not been the subject of a prior payment at the time of booking must be paid by the Client at the latest during the Check-out.
ARTICLE 8: CLAIMS

8.1. The Domaine du Fortin is bound by the guarantee of conformity of the services, under the conditions laid down in Articles L. 111-2. of the French Consumer Code, without prejudice to any additional contractual guarantee that may be specifically agreed between the parties, outside these general conditions, in accordance with a written contract duly signed by the parties.
8.2. The Domaine du Fortin endeavours to ensure that the photographs, graphic representations and texts provided provide as accurate an overview as possible of the accommodation, catering and other additional services offered. However, the Photographs are non-contractual because, due to the change of furniture, new decoration or possible renovations. Subject to availability, with the exception of a reservation made with an express request for the allocation of a private room and which would be confirmed in writing by Le Domaine du Fortin, the Customer cannot claim any claim for this fact, since these variations do not concern the essential characteristics of the service.
8.3. The Domaine du Fortin shall not be held responsible for the non-performance or the poor execution of the reservation in the event of force majeure, de facto by the third party, by the customer or by its partners, such as the unavailability of the internet network, impossibility of access to the website, external intrusion, computer viruses or in case of online payment the refusal of the bearer banker to authorize the transaction.
8.4. Although Le Domaine du Fortin offers in the establishment a service of access to internet by wifi, in the event of failure of operation of this service not attributable to the establishment, in whole or in part, for whatever reason, during the duration of the stay in the establishment, it cannot result for the benefit of the Client any right to cancellation of the reservation, or the refund of the reservation, or any compensation whatsoever.
8.5. The Domaine du Fortin shall not be liable for any indirect and/or intangible damages, in particular loss of profit, loss of use, done by the third party, done by the customer or done by its partners.
8.6. Hyperlinks on the website www.ledomainedufortin.com may link to others
8.7. Safes are available to guests in each room. In no case will the establishment be responsible for theft or damage caused to the value effects left by the Customer in the rooms of the establishment.8.8 The Domaine du Fortin cannot be held responsible for the damage caused by animals present in the establishment, which remain under the responsibility of their owner or guardian in accordance with the provisions of article 1385 of the Civil Code. The Domaine du Fortin reserves the right to charge the owner or guardian, at the rate of the damages caused. Pets are not allowed in the property.
ARTICLE 9: INFORMATION TECHNOLOGY, FREEDOM AND PRIVACY, RIGHT TO THE IMAGE
9.1. The information requested from the Customer during the secure booking process is mandatory if it is an asterisk for Amenitiz, acting as a data controller, its service providers (payment, online booking) acting on behalf of Le Domaine du Fortin.
They allow the processing of the order, the management of the customer file and the management of the newsletter.Regarding the newsletter or informative newsletter, the Customer may accept to receive by e-mail, whatsapp or sms, special offers and information on any new service created by Le Domaine du Fortin. He is informed that he can unsubscribe at any time by clicking on the dedicated link in the e-mail or text message.The information communicated to Le Domaine du Fortin is kept for a period in accordance with the legal provisions in force.In accordance with the provisions of Law no. 78-17 of 6 January 1978 on IT, files and modified freedoms, each Customer has a right of access, rectification, opposition, erase the information about him by contacting [email protected]
9.2. The reservation of nights and/or extras in the establishment concerned and their consumption by the Customers and/or their accompanying persons, or even the mere presence in the establishment does not in any way authorize any audiovisual recording operation, shooting, photography in the premises and outbuildings of the establishment including rooms for their commercial, promotional, advertising, press relations or public relations use, website illustration, etc..., and more generally of any collective use or likely to involve a public. The interior architecture graphic creations adorning the common areas and the rooms of the establishment are protected by copyright, whose rights are entirely reserved. Any audiovisual recording session, shooting, reproduction or representation of images containing the premises and dependencies of the institution concerned other than for a strictly private use is subject to the prior authorization of Le Domaine du Fortin under penalty of infringement, in particular, by the civil and criminal provisions of the Intellectual Property Code.
ARTICLE 10: MISCELLANEOUS
10.1. These general conditions are governed by French law.
10.2. In the event that one of the provisions of these General Conditions is declared null or void, in any way and for any reason whatsoever, it shall be deemed unwritten and shall not lead to the nullity of the other provisions.All disputes that may arise between the parties in connection with the interpretation and/or execution of these General Terms and Conditions shall be submitted, failing an amicable agreement, to the exclusive jurisdiction of the competent court under the jurisdiction of the Court of Appeal of Paris, with the exception of disputes concerning persons who are not traders and for which the legal rules of jurisdiction apply.
10.3. Please note that all rooms are non-smoking. If you light a cigarette inside Le Domaine du Fortin we will be obliged to charge you a fine of 150 euros on your bank card.10.4. Many decorative items are arranged in our rooms. If you like them as much as we do, you can buy them. If you leave by chance with one or more objects, Le Domaine du Fortin will charge your bank card directly.Our rates are available upon request.
ARTICLE 11: RENTAL OF THE PROPERTY
The Owner agrees to rent the Property to the Principal Tenant (Seasonal Rental) or Client (Guest House) for the requested rental period, in accordance with the following Terms and Conditions.
11 BOOKING/ DEPOSIT
11.1 Seasonal Rentals
11.1.1 A deposit of 30% of the total rental price is required to validate the booking.The deposit is due upon booking and is non-refundable.
The balance of the total amount of the reservation is due 30 days from the date of arrival of the Tenant.
11.1.2 SURETY
A deposit of € 3,000 is requested to cover any damage or damage caused to the property or its equipment during the rental period.
The amount of the deposit will be pre-authorized and blocked 2 days before the arrival of the Tenant. If no damage or deterioration is found at the end of the rental period, the deposit will be released within 21 days of the Tenant’s departure.In case of damage or damage, the deposit will be taken accordingly.
11.1.3 CANCELLATION
This contract is binding from the date of signature and payment of the deposit.
If the Owner or the Property Manager does not receive the deposit within three days, this contract will be automatically cancelled.
If the Owner or the Property Manager does not receive the balance within three days, this contract will be automatically cancelled.
If the Principal Lessee wishes to cancel this agreement, he must immediately inform the owner or manager of the Property in writing.The 30% deposit is not refundable and will be kept by the Owner.
If the Principal Tenant cancels less than 30 days before the arrival date, all monies paid by the Principal Tenant will be retained by the Landlord, with the exception of the deposit.
In the unlikely event that the Landlord should cancel this Agreement, all monies paid by the Principal Lessee will be returned to the Landlord.
11.1.4. TARIF
The rental price includes:- Gas, electricity, water and wifi- Pool water heating (for heated pools)- Weekly maintenance of the pool and garden (This maintenance can be done during the stay of the Tenant)- Intervention of a household team in the middle of the week- For stays of 15 days or more, change of sheets/towels on Fridays.
Electric vehicles: a supplement of 25 €/day will be applied. Please note that phone calls made from a landline of the property are not included in the rental price and will be deducted from the deposit.
ARRIVALS/DEPARTURESCheck-in on arrival from 5 pm.Check-out at 10 am on the day of departure.
11.2 Guest house
11.2.1 A deposit of 50% of the total price of the stay is required to validate the reservation.The deposit is due upon booking.The balance of the total amount of the reservation is due 07 days from the date of arrival of the Tenant.
11.2.2 SURETY BOND
A deposit of 1000 € is requested to cover any damage or damage caused to the property or its equipment during the rental period.
The amount of the deposit will be pre-authorized and blocked 2 days before the customer’s arrival.If no damage or deterioration is found at the end of the stay period, the deposit will be released within 21 days of the Tenant’s departure.In case of damage or damage, the deposit will be taken accordingly.
11.2.3 CANCELLATION
This contract is binding from the date of signature and payment of the deposit.
If the Owner does not receive the deposit within three days of booking, this contract will be automatically cancelled.
If the Owner does not receive the balance within seven days of arrival, this contract will be automatically cancelled.
If the customer wishes to cancel this contract, he must immediately inform the owner or manager of the Property in writing.
If the customer cancels with more than 30 days before the day of arrival, the deposit will be refunded in full.
If the guest cancels between 29 and 7 days before arrival, he will have a penalty of 50% of the amount of the stay.
If the guest cancels 6 days before the day of arrival, he will have a penalty of 100% of the amount of stay.
11.2.4. TARIF
The room price includes:- Breakfast- The intervention of a daily household team- Change of sheets/towels every 2/3 days

ARRIVALS/DEPARTURESCheck-in on arrival from 3 pm.Check-out at 12 o'clock on the day of departure.
12. INVENTORY
An inventory will be conducted with the Property Manager (or their representative) in the presence of the Tenant on arrival and on the day of departure.
13.CELLAR and MINI-BAR
The wine, champagne and all the drinks of the cellar and mini-bars are at the tenant’s disposal. He can be served at will. An inventory allows the person in charge of the property (or his representative) to know the quantity of bottles available. A rate will be provided to the tenant. At the end of the stay, the tenant will pay the owner his consumption.
14. OCCUPANCY OF PREMISES
The Property can accommodate up to 10 people. Please specify the exact number of adults and children to be housed on the Property, as well as the age of the children. The Principal Tenant is financially and legally responsible for all occupants during the rental period. If the maximum number of occupants is exceeded without the consent of the Owner, the Owner reserves the right to ask these occupants to leave the premises immediately, or to levy an additional charge on the amount of the deposit. The Principal Lessee declares having read, understand and accept these Terms and Conditions on behalf of all occupants of the Property during the rental period.
15. OBLIGATIONS OF THE PRINCIPAL LESSEE
The Principal Tenant, on his behalf and on behalf of all occupants, undertakes to:- occupy the Property as a temporary private residence- not to engage in any commercial activity or service on the Property- keep the Property in good condition- not to engage in or permit illegal activity on the Property- refrain from any activity that could harm the tranquility of the Owner or neighbours- no smoking inside the house- do not introduce pets on the Property without the consent of the Owner- let in the Owner, the manager or any authorised person in case of need of repair or maintenance during the rental period- immediately inform the Property Manager in the event of degradation of the property or its equipment
16. OBLIGATIONS OF THE OWNER The Owner undertakes to:- make available the Property in good condition- ensure that the Property and all its equipment are in good working order- ensure that the Main Tenant and the occupants can enjoy the Property in peace during the rental period- not carry out work on the Property during the rental period, outside of emergency situations, and weekly maintenance of the pool and garden.
17. SWIMMING POOL Safety around the pool is of the utmost importance.Children must be under constant adult supervision and never left unattended.The Principal Tenant and the occupants undertake to assume full responsibility for the safety of the group at all times, in and around the pool.Neither the Owner nor the Property Manager can be held responsible in the event of injury or accident in connection with the pool.
18. SECURITY AND VALUABLES The Principal Tenant and the occupants leave their valuables on the Property at their own risk.The Owner cannot be held responsible in case of loss. It is the responsibility of the Principal Tenant and the occupants to guard against theft and break-in.Doors, shutters, windows and entry points must be closed and locked when the Property is unoccupied.
19. INSURANCE It is strongly recommended that the Primary Tenant and occupants take out all-hazards travel insurance.
20. FORCE MAJEURE A "force majeure event" is an event beyond the control of a party and includes fires, earthquakes, hurricanes, floods, political revolutions, pandemics or any other unpredictable circumstance.Neither party shall be liable to the other if prevented by force majeure from fulfilling its obligations.If a case of force majeure results in the departure of the Principal Tenant and the occupants of the Property during the rental period, the Owner agrees to reimburse the Principal Tenant in proportion to the period of the unoccupied rental.
21. PRIMARY TENANT LIABILITY The Principal Lessee shall be liable for any damage or loss caused to the property and its equipment during the rental period, unless proven to have been caused by force majeure, by the Owner, the property manager or a third party.The Tenant must leave in perfect condition and clean all the equipment of the house (summer kitchen, oven, etc.) otherwise he will have an extra 50 € for each hour dedicated to update the equipment in question.The Principal Tenant will be responsible for all invoices accumulated during the rental period and outstanding after the departure date.
22. OWNER’S LIABILITY The Owner is not responsible for events beyond his control (adverse weather conditions, delays, political revolution, pandemic, etc.). The Owner shall not be liable for any injury, loss or damage suffered by the Principal Lessee and its occupants, their property or vehicles during the rental period. The Owner is not responsible for accidents to third parties.
23. LOSS OF USE The Main Tenant acknowledges and accepts that the Owner is not responsible for any "loss of enjoyment" due to factors beyond its control, such as the loss of WIFI, television reception, weather conditions, poor health, failure of other operators, etc.
24. JURISDICTION This contract shall be governed by and interpreted in accordance with French law.The Principal Lessee agrees, on behalf of itself and the occupants, that the French courts shall have exclusive jurisdiction to settle any dispute arising out of or in connection with the General Conditions of this Agreement.The terms and conditions of this Agreement are acknowledged, understood and accepted.
